BC Election said that under the Election Act, a judicial recount must take place if, at the conclusion of final count, the difference between the top two candidates is less than 1/500 of the total ballots considered. In West Vancouver-Sea to Sky, the threshold for a judicial recount is 49 votes. The difference between the top two candidates is 41 votes, out of 24,769 votes considered.
A judicial recount is conducted by the Supreme Court of British Columbia, and may include some or all of the ballots and certification envelopes for an election. The timing of the recount will be determined by the Court.
