AFTER a tragic overdose death in December 2017, the New Westminster Police Department Street Crime Unit engaged in a project to investigate the suspected source of drugs. Over the course of the investigation, evidence of drug dealing was collected and a search warrant was obtained.
On April 5, members of the NWPD Street Crime Unit and the Lower Mainland Emergency Response Team executed a search warrant at an address in Delta. As a result of the warrant, two adult men were taken into custody without incident.
From the search, two vehicles were seized along with cocaine, oxycodone, marijuana, a large amount of cash, and two prohibited handguns. The total amount of drugs from the seizure had an estimated street value of approximately $6,000.
Elliott Eriq Bains, 19, and Devin Dallas Bains, 21, of Delta were arrested and charged with the following offences:
Count 1: Trafficking in a controlled substance, to wit: cocaine.
Count 2: Possession of a controlled substance, to wit: cocaine, for the purpose of trafficking.
Count 3: Possession of a controlled substance, to wit: oxycodone, for the purpose of trafficking.
Count 4: Possession of an unloaded prohibited or restricted firearm, to wit: a Glock semi-automatic handgun, with readily accessible ammunition that is capable of being discharged in the firearm, without being the holder of an authorization or a licence under which he may possess the restricted firearm in that place and a registration certificate for the firearm.
Count 5: Storing a firearm, to wit: a Glock handgun, in a manner contrary to a regulation of the Firearms Act.
Count 6: Possession of an unloaded prohibited or restricted firearm, to wit: an ISSC semi-automatic handgun, with readily accessible ammunition that is capable of being discharged in the firearm, without being the holder of an authorization or a licence under which he may possess the restricted firearm in that place and a registration certificate for the firearm.
Count 7: Storing a firearm, to wit: an ISSC Handgun, in a manner contrary to a regulation under the Firearms Act.
Count 8: Possession of a firearm, to wit: an ISSC semi-automatic handgun, knowing that the serial number on it has been altered, defaced, or removed.
Devin Bains was charged with the additional offenses:
Count 9: Possessing a prohibited or restricted firearm, to wit: a North American Arms revolver handgun, without being the holder of a license under which he may possess it and a registration certificate for the firearm.
Count 10: Storing a firearm, to wit: a North American Arms revolver handgun, in a manner that contravenes the Storage, Display, Transportation and Handling of Firearms by Individuals Regulations under the Firearms Act.
“We’ll continue to arrest and forward charges against people who are profiting from the sale of illegal, and often dangerous, drugs in our community,” stated media relations officer Sgt. Jeff Scott. “Given the current opioid crisis in our province, we will continue to disrupt the enterprise of drug dealers through targeted enforcement. Additionally, our officers are devoting time to educating the public about the risk of drug use, and to provide support for those who are seeking help.”
Devin and Elliott Bains were held in custody to appear in court.
